This Privacy Policy explains how DKB Advocates, a proprietary law practice of Adv. Darshit Bhanderi, enrolled with the Bar Council of Gujarat, handles personal information collected through the website https://dkbadvocates.in (the "Website").

This Website is informational in nature. It is not an advertisement or a solicitation of work. Please also read our Disclaimer and Terms of Use, which apply to your use of the Website.

By using this Website or submitting the enquiry form, you agree to the practices described in this Policy.

1. Who we are

For the purposes of the Digital Personal Data Protection Act, 2023 ("DPDP Act"), DKB Advocates is the Data Fiduciary in respect of personal data collected through this Website. If you submit information to us, you are the Data Principal.

2. What information we collect

a) Information you give us. The Website has a single enquiry / consultation form. It collects only:

• Your name
• Your email address
• Your phone number
• The message you choose to write

That is the entire set of fields. There is no facility on this Website to upload documents, create an account, subscribe to a newsletter, or post comments.

b) Information collected automatically. When you browse the Website, our analytics tools may record technical and usage information such as your IP address, browser and device type, approximate location (city level), pages viewed, time spent, referring website, and mouse movement / click and scroll behaviour on the page. See Section 6.

c) WhatsApp. The "Send WhatsApp Message" button simply opens WhatsApp with our number pre-filled. It is your own WhatsApp application that sends the message. We do not capture, log, or store your number through the Website when you click it. Any conversation that follows takes place on WhatsApp and is governed by WhatsApp's own privacy policy.

3. Please do not send confidential case material

The enquiry form is for initial contact only.

Please do not send case papers, property documents, revenue records, evidence, or sensitive details of an ongoing or contemplated dispute through this Website. Submitting the form does not create an advocate–client relationship, and information sent before we are formally engaged may not be protected by advocate–client privilege.

If a matter is taken on, confidentiality will be governed by our engagement terms and by the professional obligations that apply to an advocate under the Advocates Act, 1961 and the Bar Council of India Rules — not by this Website.

4. Why we use your information, and on what basis

We use the information you submit only to:

• read and understand your enquiry;
• contact you by phone, email or WhatsApp to respond to it; and
• decide whether the matter is one we can take up.

We rely on your consent, given when you voluntarily submit the form, as the lawful basis under the DPDP Act. We use analytics data to understand how the Website is used and to improve it.

We do not use your details for marketing, promotional messaging, or newsletters. We do not sell, rent, or trade personal information to anyone.

5. How your information is stored, and for how long

Enquiries submitted through the form are delivered to our email inbox. They are not stored in any database on this Website and are not entered into any CRM or marketing system.

We retain enquiry emails for one (1) year from the date of receipt, after which they are deleted, unless:

• the enquiry has resulted in an engagement, in which case the material becomes part of the client file and is retained under our professional record-keeping obligations; or
• retention is required by law, or for the establishment or defence of a legal claim.

Our website and its servers are located in India. We do not transfer your personal data outside India, except to the extent that the third-party services listed in Section 6 process technical data on their own infrastructure.

6. Cookies and third-party services

The Website uses the following third-party services. Each is operated independently and collects data under its own privacy policy:

These services place cookies and similar technologies on your device. Microsoft Clarity may record your session, including cursor movement, clicks and scrolling on our pages, so that we can see where visitors get stuck. Clarity is configured to mask text entered into form fields.

You can block or delete cookies through your browser settings. Blocking them will not prevent you from reading the Website, though reCAPTCHA and embedded content may stop working, and the enquiry form may not submit.

7. Sharing

We do not disclose the information you send us to any third party, except:

• to the service providers in Section 6, in the ordinary technical operation of the Website;
• to our website developer, where necessary to maintain or repair the Website;
• where disclosure is required by law, by a court, or by a statutory or regulatory authority; and
• where required or permitted under the Advocates Act, 1961 and the Bar Council of India Rules.

8. Security

We take reasonable technical and organisational measures to protect information submitted through the Website, including transmission over HTTPS and restricted access to the email account that receives enquiries.

No method of transmission over the internet is completely secure. We cannot guarantee absolute security, and information you send us over the internet is sent at your own risk. This is one of the reasons we ask you not to send case documents through the Website.

9. Your rights

Subject to the DPDP Act, you may:

• Ask what we hold about you and how it has been used;
• Ask us to correct information that is inaccurate, incomplete or out of date;
• Ask us to erase your enquiry, where we are not required to retain it;
• Withdraw your consent at any time, after which we will stop using your details to contact you and will delete the enquiry, unless retention is legally required;
• Nominate another person to exercise these rights on your behalf in the event of your death or incapacity; and
• Raise a grievance with us (Section 10) and, if unresolved, with the Data Protection Board of India.

To exercise any of these, write to dkbadvocates@gmail.com from the email address used in your enquiry. We will respond within a reasonable period, and in any case within thirty (30) days.

Withdrawing consent does not affect anything lawfully done before the withdrawal.

11. Children

The Website is not directed at children. We do not knowingly collect personal data of a child (a person below eighteen years of age) through this Website. If you believe a child has submitted information to us, please write to us and we will delete it.

The Website links to external sites, including our Instagram, LinkedIn and Facebook pages. We do not control those sites and are not responsible for their content or their privacy practices. This Policy applies only to https://dkbadvocates.in.

13. Changes to this Policy

We may update this Policy from time to time. The revised version will be posted on this page with a new "Last updated" date. Please check this page periodically. Continued use of the Website after an update means you accept the revised Policy.

14. Governing law

This Policy is governed by the laws of India. Any dispute arising out of or in connection with it is subject to the exclusive jurisdiction of the courts at Rajkot, Gujarat.
